1. General Terms

These Terms and Conditions govern the relationship between "GOOL SOUND KRASIMIR ILIEV" LTD., UIC/PIC 148136801 (hereinafter referred to as the "Company") and users of the website cool-sound.eu (hereinafter referred to as "Users") in connection with access, use, and purchase of offered digital products – instrumentals (also known as backing tracks, singback tracks). By accessing cool-sound.eu (hereinafter referred to as the "Website") or placing an order, the User explicitly declares that they are familiar with, understand, and accept these Terms and Conditions. If the User does not agree with these terms, they should immediately cease using the Website.

2. Subject of Service

The website offers instrumentals (backing tracks / singback tracks) intended for vocal performances, rehearsals, and preparation for stage performances. All instrumentals represent recreated versions of existing musical works created by Krasimir Iliev during the period 1992–2022 through an individual creative and technical process. No artificial intelligence was used in the creation of the instrumentals in any form.

3. Copyright and Related Rights

The instrumentals offered on the website represent recreated versions of existing musical works and do not constitute original musical works in themselves. For the specific sound recording realization (including arrangement, sound recording, production), Krasimir Iliev and the Company hold related rights within the meaning of the Law on Copyright and Related Rights (ZAPSP), including the right of distribution. Copyright on the original musical works belongs to the respective copyright holders. Any use of the original works beyond what is permitted by law is entirely the responsibility of the User. Listening to excerpts through the Website is informational in nature only and does not constitute the provision of a license. Where the Website provides the ability to listen to short excerpts from original works, this is done solely for the purpose of user review and orientation and only to the extent permitted by applicable law (Art. 24, Section 2 ZAPSP). This does not constitute the provision of a license or rights to use the original works.

4. License for Use

Upon purchase of an instrumental through the Website, the User receives a limited, non-exclusive, and non-transferable license for personal use. The User does not acquire ownership of the content, but only the right to use it within the scope of these Terms. Any use outside the provided license (including public performance) requires prior permission from the respective copyright holders.

5. Management of Rights through "Muzikautor"

The copyright of the offered instrumentals is managed through SNC "Muzikautor" (UIC 831005050) for works included in their repertoire. The offered instrumentals are for personal use by the end user only, and any public performance, recording, reproduction, and distribution is subject to additional permission from SNC "Muzikautor". The Company is not responsible to "Muzikautor" or other parties for non-compliance with the above restrictions by Website Users.

6. Restrictions on Use

The User has the right to use the content of the website solely for personal and non-commercial purposes. Without explicit permission from the respective copyright holders, the User has no right to: - use instrumentals for public performances; - record and distribute works with them; - provide, sell, or transfer files to third parties; - use content for commercial purposes. It is forbidden to circumvent technical restrictions, as well as any actions aimed at illegally extracting or mass downloading of content.

7. Responsibility

The Company is not responsible for: - unlawful use of purchased instrumentals by Users; - violations of copyright or related rights committed by Users; - actions of third parties resulting from unlawful distribution of content. The Company's liability, to the extent applicable, is limited to the value of the purchased product.

8. Payments and Access to Content

Access to purchased instrumentals is provided within 3 business days after confirmed bank payment. All prices are announced in accordance with applicable law and may be changed without prior notice. The Company is not responsible for delays caused by payment providers or technical issues outside its control.

9. Personal Data (GDPR)

Data Controller: "КУУЛ САУНД КРАСИМИР ИЛИЕВ" OOD, UIC/PIC 148136801 ("Company"). The Company processes Users' personal data in accordance with applicable law, including Regulation (EU) 2016/679 (GDPR) and the Law on Personal Data Protection. Categories of data: - name; - email; - phone; - billing information; - order information. Personal data is collected solely for the purposes of: - order processing; - communication with Users; - fulfillment of legal obligations. Users have the right to access, correct, and delete their personal data, as well as other rights provided by law.

10. Personal Data Retention Period

Personal data is retained for the period necessary to fulfill the purposes for which it was collected, or in accordance with the requirements of applicable law. The Company applies appropriate technical and organizational measures to protect personal data. Personal data is retained: - for the period necessary to perform the service; - in accordance with accounting and tax requirements.

11. Provision of Data to Third Parties

The Controller does not provide personal data to third parties except when necessary for: - service performance (e.g., payment providers); - fulfillment of legal obligation; - protection of legitimate interests.

The Controller applies appropriate technical and organizational measures to protect personal data against unauthorized access, loss, or misuse.
